David Thomas Driving School – Terms and Conditions
These terms and conditions govern the driving instruction services provided by David Thomas Driving School. They form a binding agreement between the student (or the party funding the lessons) and David Thomas Driving School. Any updates to these conditions will be communicated at least 7 days before taking effect. By booking or accepting a lesson with David Thomas Driving School, you agree to the following:
1. Professional Standards
1.1 David Thomas Driving School adheres to a recognized professional code of practice, which is available for review on the appropriate regulatory website (e.g., the UK’s official code of practice).
1.2 David Thomas Driving School commits to the following:

Providing a vehicle that is legally roadworthy, fully insured, taxed, and—if required—has a valid MOT certificate.

Ensuring that the vehicle is kept clean, orderly, and equipped with dual controls.

Maintaining courteous and professional conduct at all times, avoiding any inappropriate language or behavior.

Refraining from making or accepting calls or texts during lessons unless an emergency occurs and the vehicle is safely parked.
2. Licensing Requirements
2.1 Students must possess a valid and current driving licence authorizing them to drive in the UK.
2.2 Students must meet all legal medical and vision standards, including the ability to read a number plate from the prescribed distance (using glasses or contact lenses if needed). If corrective lenses are required, they must be worn throughout the lesson.
2.3 Your driving licence should be presented at the first lesson and may be reviewed periodically. Any penalties, restrictions, or endorsements on your licence must be disclosed immediately.
3. Student Fitness
3.1 It is the student’s responsibility to ensure they are physically and mentally fit to drive. Please notify David Thomas Driving School as soon as possible if you have any medical condition, disability, or injury that might affect your ability to drive safely.
3.2 Students must not drive if under the influence of alcohol (including lingering effects) or drugs (including medications that may cause drowsiness). Avoid scheduling lessons when fatigued, stressed, or distracted.
3.3 Appropriate footwear and comfortable clothing that allows free movement are required for safe driving.
4. Expected Conduct
4.1 Abusive or aggressive language or behavior directed toward David Thomas Driving School or any other road user will not be tolerated.
4.2 David Thomas Driving School reserves the right to end a lesson immediately if, in its sole judgment, the student’s behavior or condition renders it unsafe or inappropriate to continue. In such cases, the fee for that session will not be refunded.
5. Payment and Fees
5.1 Lesson fees will be communicated before or at your first lesson. Any changes to the fee structure will be announced in advance.
5.2 Special offers or discounts are provided at the sole discretion of David Thomas Driving School and may be modified or withdrawn without notice.
5.3 Payment for lessons is due in full either in advance or at the start of the session.
5.4 Accepted payment methods include cash, debit card, bank transfer, Pingit, or Paym.
5.5 When you pay directly to David Thomas Driving School, you acknowledge that the contract for providing lessons is with David Thomas Driving School, which assumes full responsibility for the service.
5.6 Credit facilities are not offered—lessons will only proceed once payment is received.
6. Instructor Consistency
Lessons will consistently be delivered by David Thomas Driving School. In the unlikely event a lesson cannot be conducted due to unforeseen circumstances, you will be promptly informed and an alternative schedule will be arranged. No substitution by another instructor is available.
7. Vehicle Changes
7.1 Occasionally, a change in the vehicle may be necessary—due to maintenance or unforeseen issues.
7.2 If a replacement vehicle is provided and you opt not to proceed, any associated fees (e.g., test fees) remain your responsibility.
7.3 Should you request the familiar vehicle, David Thomas Driving School will try to accommodate the request within reason.
8. Instructor-Initiated Cancellations
8.1 Lessons may need to be canceled at short notice due to adverse weather, vehicle issues, illness, or emergencies. David Thomas Driving School will notify you as soon as possible.
8.2 The lesson will be rescheduled at a mutually convenient time.
9. Student-Initiated Cancellations
9.1 Please give at least 48 hours’ notice to cancel a lesson. Cancellations without this notice will be charged in full.
9.2 Cancellations must be confirmed via text or direct communication with David Thomas Driving School.
9.3 Repeated short-notice cancellations may result in:

A requirement for longer notice periods,

Advance payment for future lessons,

Or termination of the instruction service.
9.4 If you are deemed unfit to drive, the lesson may be canceled, with the session fee retained.
10. Scheduling and Punctuality
10.1 It is your responsibility to track lesson times.
10.2 David Thomas Driving School will wait for 10 minutes beyond the scheduled start before deeming the lesson canceled.
10.3 Delays due to traffic or unforeseen events may occur; please allow for a 10-minute grace period.
10.4 If the instructor arrives late, the lost time may be adjusted or rescheduled.
10.5 Changes to pick-up/drop-off points require 24 hours’ notice and may affect lesson timing.
11. Arranging Driving Tests
11.1 Only book tests after confirming readiness and availability with David Thomas Driving School.
11.2 David Thomas Driving School is not responsible for tests booked without agreement.
11.3 If unavailable, every effort will be made to arrange an alternative. You must accept any offered vehicle.
11.4 Test use of the vehicle is charged at the standard lesson rate.
11.5 You must provide accurate test details; the school is not liable for misinformation.
11.6 Vehicle use for the test is at the instructor’s discretion based on your readiness.
12. Test Cancellations
12.1 If a test is canceled due to instructor or vehicle issues, credit toward the next test fee will be offered.
12.2 David Thomas Driving School is not liable for additional lesson costs during rescheduling.
12.3 Assistance will be given in arranging a new date; vehicle substitution may occur.
12.4 If DVSA cancels your test for reasons other than weather and notice requirements are met, lesson/test fees still apply.
12.5 DVSA may refund some fees if they cancel on short notice.
12.6 A new test date will be arranged at no cost if DVSA cancels (excluding weather-related reasons).
12.7 In weather-related cancellations, DVSA reschedules at no cost, but your lesson/test fees still apply if notice wasn’t met.
12.8 Test cancellations due to your documentation errors or other personal factors remain fully chargeable.
13. Refund Policy
13.1 Prepaid lessons are refundable if canceled with appropriate notice.
13.2 Discounts for prepayment will be reversed for completed lessons, and late cancellations are non-refundable.
14. Supervision and Observation
14.1 Trainers or examiners may observe lessons occasionally. Consent will be requested.
14.2 Supervising examiners may be present during driving tests.
14.3 You may choose to have the instructor accompany you during the test.
14.4 With prior agreement, a friend or relative may observe your lesson.
15. Using Your Own Vehicle
15.1 You may request lessons in your own vehicle, subject to:

Instructor agreement and assessment in the school’s car,

Legal compliance (roadworthy, taxed, insured, MOT if required),

Insurer confirmation of coverage for professional instruction.
15.2 You accept all risk and liability when using your own vehicle.
16. Personal Belongings
16.1 You are responsible for your belongings during lessons.
16.2 David Thomas Driving School is not liable for lost or damaged items.
17. Legal Responsibilities
17.1 You are legally responsible for traffic offenses during your control of the vehicle.
17.2 David Thomas Driving School is not liable for driving errors outside of lessons or after passing your test.
18. Handling Complaints
18.1 Report concerns promptly, preferably in writing within seven days.
18.2 Reasonable efforts will be made to resolve issues. You may escalate to the DVSA if needed.
19. Privacy and Data Protection
19.1 Your personal data is stored securely and used solely for providing lessons.
19.2 Your information is not shared without your consent, unless legally required.
19.3 You may receive occasional updates or offers and may opt out anytime.
20. Photography and Social Media
20.1 Photos may be taken for promotional use on social media platforms like Facebook and similar and this website.
20.2 If you prefer not to be included in such content, notify David Thomas Driving School in writing beforehand.
These terms and conditions constitute the entire agreement between you and David Thomas Driving School.
